Ministerial Decree No. 247/2007 extended, starting from 7 November 2007, the right to maternity leave  (mandatory leave) and early leave from work, previously provided only for employed workers, to workers enrolled in the Gestione separata Inps who are not pension holders, are not enrolled in other social security schemes, and who pay:

  • from 1 January 2015 the rate of 30.72%
  • from 1 January 2016 the rate of 31.72%
  • from 1 January 2017 the rate of 32.72%
  • from 1 January 2018 the rate of 33.72%

Procedure
The collaborator is required to notify the Employer (Head of Service, Department Director or Operating Unit Director) as promptly as possible of any pregnancy (Forms Section), attaching the medical certificate issued by the affiliated gynecologist for the purpose of assessing the existence of a specific risk in terms of health and safety connected with her activity.
The Employer will identify a duty free from risks pursuant to Legislative Decree No. 151/2001.
The following types of leave are provided for, as further specified in the attachment "Types of Leave":

  1. Mandatory leave
  2. Early leave
  3. Flexible leave

Maternity allowance
When the obligation to take leave from work arises under the terms indicated above, the contractual activity is suspended without payment of compensation and the payment of an allowance replacing remuneration is provided for (maternity allowance). The financial benefit is paid by Inps and is equal to 80% of the income deriving from coordinated and continuous collaboration earned in the twelve months preceding the leave.
