Who is the Workers' Safety Representative (RLS)
Workers' Safety Representative is "a person elected or appointed to represent workers with regard to aspects of health and safety at work" (Legislative Decree no. 81/2008, art. 2 - Definitions)
With Legislative Decree no. 81/2008 we tried to give a more incisive role to the figure of worker representative for safety (RLS) through some innovations introduced in art. 47 et seq. and highlighting its function as guarantor of workers' rights of participation and control in the field of health and safety at work.
In the activity of the RLS, the greater involvement of workers in the preparation and updating of protection and prevention measures is enhanced, its function as a decisive link between the needs of workers and the company's contact persons.
Legislative Decree no. 81/2008 confirmed the advisory and control tasks of the RLS, with the right to receive information from supervisory bodies; in particular, the right of the RLS to obtain a copy of the risk assessment document (DVR) provided for by art. 17 and 28, even if the recent corrective decree law 106/09 limits the consultation of the same only within the company. For the RLS, an active role of collective bargaining is also envisaged, which may introduce further powers and a particular discipline for those already listed in art. 50, which also expands, in point 2, with respect to 626, the right to have "means and space necessary for the exercise of the functions and faculties recognized to him".
In the supplementary and corrective provisions to the decree, there is also the possibility, on the part of the employer, to deliver to the RLS, the risk assessment document "on computer support". Therefore, the RLS, upon request, must receive a paper copy of the risk assessment document and, in addition, if drafted, the document on computer support: a useful facilitation of access, reading and use. It is useful to remember that Article 26 (paragraphs 3 and 5) also extends this right to the Single Interference Risk Assessment Document (DUVRI), a copy of which may be requested both by the RLS of the client company and by the RLS of the contractors. This is to enable workers' representatives to carry out their role with greater awareness. The RLS is required to comply with the provisions of Legislative Decree no. 196 of 30 June 2003 and with the industrial secrecy regarding the information contained in the risk assessment document and the single risk assessment document (DVR), as well as the secrecy regarding the work processes of which it becomes aware in the exercise of its functions
