For me, doing research in comparative public law means approaching different legal systems, institutions, provisions, in order to understand how similar issues have been solved in different contexts.
In particular, during my research activity, I have been focusing on the development, regression, promotion, and protection of human rights through the lens of comparative constitutional case law (CCCL). In fact, to understand the meaning of fundamental freedoms, legal scholars cannot just refer to their national system. Reference to the EU (e.g. the European Court of Justice), or the European Court of Human Rights (ECtHR), or other international or regional systems (such as the Inter-American system, the ICCPR system, etc) are necessary to grasp the essence human rights provisions.
Specifically, my areas of interest are:
The principle of equality
Direct democracy in constitutional democracies (e.g. its “potential impact” on minority rights)
The rights of LGBTI people
The right to gender identity
The role of constitutional judges in the protection of fundamental rights
The conflict between supreme judges and legislative power in the (re)definition of constitutional guarantees.
The different interpretative techniques adopted by Constitutional Courts (e.g. the delayed declaration of unconstitutionality)
The relationship between courts in the European system.
